In a terrifying incident in Pilsen, the Czech Republic, an 88-year-old woman was wrongly declared dead. Her partner called the emergency call because he couldn't wake her up and assumed that she had died. This meant that a doctor who acted as an official body viewer issued a death certificate. The incident occurred on Friday, about 90 kilometers west of Prague

The dramatic turn came when the woman who was thought to be dead opened her eyes as an employee of a funeral home put her in the coffin. This meant that the employees immediately alerted the emergency services that took the woman to the hospital. The health state of the senior citizen is described as stable; She is doing well with age and her previous illnesses.

Investigations against the doctor

The police have now initiated investigations against the doctor because there is suspicion of the failure to assist. This type of crime is regulated in Germany by Section 323c of the Criminal Code and refers to situations in which someone does not act in an emergency situation, although this would be necessary and reasonable. The aim of the legislator is to promote interpersonal solidarity and create a system that stimulates action in critical moments.

In the case of the 88-year-old woman, the question arises whether the doctor had the correct handling of the situation or whether it was failed to carry out a medical examination before a certificate of death was issued. If it turns out that it was due to the doctor, this could have serious legal consequences.

The funeral company, which is responsible for obtaining the "coroner", expressed regret for the incident. According to a change in the law in 2011, the “coroner” in the Czech Republic is responsible for determining identity and the cause of death. The company plans to draw personnel consequences to ensure that such errors do not occur.

This tragic confusion also causes memories of other cases in which failed assistance led to serious consequences. A prominent example is the case of Daniel Küblböck, who died in late summer 2018 after he probably jumped from the deck of a cruise ship. His father raises allegations against the authorities for failing to provide assistance, which could initiate the discussion about the legal framework and responsibility in such situations.

The prerequisites for punishable failure to provide assistance, as are anchored in German law, show that both legal and ethical considerations play a role in such emergency situations. It is crucial that it is reacted quickly and appropriately in acute layers to prevent such worrying incidents.
