The package travel law in Germany ensures an appropriate balance of interests between travelers and tour operators and therefore represents an important component of consumer protection. Providers are obliged to provide the travel services in accordance with the agreements made. This also means that consumers can rely on flight times and consciously choose the scope of services and travel times.

Loud MDR The provider must point out possible changes in the contract. However, such changes are only possible within reasonable limits. Reasonability is assessed on a case-by-case basis, taking into account criteria such as travel time, travel duration and family situation.

Contractual obligations and obligations

A package travel contract exists when at least two different types of travel services, such as flights and hotels, are offered as a package. Travelers only conclude a contract with the tour operator, not with individual service providers. The tour operator is fully liable for all travel services and possible travel defects, while travel agents are excluded from this liability.

Before booking, tour operators are obliged to transparently present the essential characteristics of the travel services, the identity and contact details of the company as well as the travel price including all taxes and any additional costs. This also applies to payment modalities and information on insolvency protection.

Traveler rights and bankruptcy protection

After booking, travelers receive a security certificate that offers further protection. In the event of travel defects, travelers have the right to have the defect rectified within a reasonable period of time. If the defects are rejected without justification, there is also the option of self-help and a claim for compensation.

In addition, if there are significant defects, travelers can terminate the contract without incurring additional costs for return transport. A reduction in the travel price and claims for damages are also possible. These claims should be filed promptly after your return, as the statute of limitations is two years.

In the event of the tour operator's insolvency, travelers are entitled to demand a refund of their travel price and to expect return transport to be guaranteed. Since November 1, 2021, larger tour operators have had to insure their offers through Deutsche Reisesicherungsfonds GmbH (DRSF), while smaller tour operators can alternatively insure through an insurance company or a credit institution. Travelers also have the option of making claims directly against the respective insurance company.
