Government fights against immigrant protests: expulsions are imminent!

Today, May 21, 2025, there is news about immigration policy in Portugal, marked mainly by the Government and the Minister of the Presidency, Pedro Portugal Gaspar. Recently, Gaspar stated that an internal reassessment of the expulsion decisions is taking place. These decisions affect not only current cases, but also the possibility for citizens who have been asked to leave the country to challenge this decision.

Another point of interest is the protests by immigrants and industry associations. They are directed against the expulsion decisions, which are partly due to the exclusion from the Schengen area. This is causing great concern and debate both within the community and in political circles.

Current situation regarding expulsion

Pedro Portugal Gaspar emphasized that inclusion in name databases occurs when crimes have been committed or expulsions from other EU countries have occurred. It is also known that a foreigner who has initiated a legalization procedure in a third country may be excluded from applying for legalization in Portugal. This significantly worsens the situation for many of those affected.

As part of these reassessments, the government announced that 4,574 foreign citizens will be notified to voluntarily leave the country within 20 days. This civil return is only the first step as a total of 18,000 immigrants are affected. Of the other 110,000 ongoing procedures, a high number of approvals, but also more rejections, are expected.

EU immigration policy

According to information from the European Parliament, the EU aims to develop a comprehensive immigration policy based on solidarity. The legal basis of this policy is set out in Articles 79 and 80 of the Treaty on the Functioning of the European Union (TFEU).

The EU sets conditions for the legal immigration of third-country nationals and allows member states to set quotas for accepting jobseekers. The EU also aims to combat illegal immigration and respect existing fundamental rights. Cooperation with third countries is crucial to conclude readmission agreements and secure the rights of legal immigrants.

The principles of solidarity and the fair distribution of responsibility among member states are particularly important in the context of migration. Particularly noteworthy are the legislative initiatives since the Treaty of Lisbon, which create the legal framework for an effective migration policy.

In summary, it is clear that Portugal is in a critical phase with the implementation and reassessment of its immigration policy. The government emphasizes the need to follow existing rules while taking humanitarian aspects into account.
