In Velden am Wörthersee, the luxury penthouse of Andreas Gabalier, an Austrian folk rock'n'roller, is about to be demolished. Gabalier paid €2.5 million to build the 155 square meter penthouse, which was originally approved as tourist accommodation. However, wealthy individuals are instead using the apartments as second homes, which has led to significant legal conflict. The situation escalated when the State Administrative Court declared the building illegal and issued a demolition notice. This judgment was confirmed by the Administrative Court in Vienna in October 2024. Now Gabalier must demolish the entire building, including the driveway, by April 30, 2025 at the latest and revegetate the property. Mayor Ferdinand Vouk from the SPÖ demands that the building corresponds to its original purpose as a purely tourist business.

Authorities and legal framework

The Carinthian authorities have been dealing with the multi-family property since 2021. The current use cannot be approved due to a negative building permit and changes to the partial development plan. The municipality has determined that the use of the apartments no longer corresponds to the original concept.
