With the new “Decree on Responsible Tourism”, which is valid until the end of 2027, the ban on alcohol in public areas has been sharply expanded. Public surrender is also prohibited and can be punished with fines of 200 to 400 euros. The sanctions against wild peeing are particularly drastic: fines can range between 750 and 3,000 euros, with even higher penalties in sensitive zones. Urinating in the sea is also forbidden. Swimming with a red flag, which signals danger to life, is punishable by fines of up to 2,500 euros, especially on beaches such as Playa de Muro and Can Picafort.

Initiatives to improve tourism

The Balearic Islands government has announced that it will provide four million euros annually from tourism tax to implement these measures. The ban on alcohol consumption will also be extended to the party zones in Ibiza in order to achieve a comprehensive curb on excessive drinking. However, there are exceptions: consumption is permitted on the terraces of restaurants and bars, as well as in certain approved places. Party boats are still allowed to serve alcohol, but must remain one nautical mile away from the affected zones and are not allowed to pick up or drop off guests there.

The new regulations are part of a broader approach that began in 2020 with a legislative package to combat excessive drinking, but took a back seat after the corona pandemic. Through these measures, the regional government hopes to create a safer environment for all tourists and locals and maintain the attractiveness of the popular holiday destination.
